This competition is run by EPOS Audio UK Limited, , Business registration no. 11738270,3800 Parkside, Solihull Parkway, Birmingham Business Park, Birmingham, West Midlands, B37 7YG, United Kingdom. The competition is administered in the United Kingdom. Therefore, English law exclusively apply to the competition regardless of the location of the individual participant.

By entering the competition, you will be bound by these terms & conditions, and you acknowledge and confirm, (i) that you satisfy all eligibility requirements, and (ii) that your employer has approved your participation in the competition.

Your participation in the campaign is on behalf of your organization, not by personal name (i.e., any winnings will be allocated to your employer and not to you personally, and it will be up to you employer – in its sole discretion – to offer the price to an employee of its own choosing).

We urge you to make sure that your organization’s participation in the campaign does not contradict or violate any of the internal rules and/or guidelines of your organization.

ELIGIBILITY OF PARTICIPANTS

1.1 The competition is available to participants who are employed by an EPOS authorised reseller in the United Kingdom AND/OR Ireland, Netherlands, Belgium, Luxembourg, Denmark, Norway, Sweden, Finland, Iceland, France, Germany, Austria, Latvia and Switzerland.

1.2 EPOS reserves the right, upon its sole discretion, to exclude participants on valid grounds, such as but not limited to:

violation of the rules of the competition; manipulation of the technical process or administration of the competition; undue conduct; or false or misleading statements regarding participation in the competition.

COMPETITION PERIOD

2.1 The competition runs from the 18th March 2024 to the 31st July 2024 on applicable deals, raised and closed between 18th March 2024 to the 31st July 2024. 

PROCEDURE OF THE COMPETITION

3.1 The competition is run through a code-based system. Each qualifying* closed deal [*sold deal that includes units of the products shown in 3.3] will earn you a “scratchcard” code. Participants can win a maximum of one prize as set out in section 3.4 of these Terms & Conditions.

3.2 Cards are awarded as follows:

If you register a deal through EPOS’ Deal Registration platform that includes units of the following products [3.3] AND you successfully close the deal [Sell the units to the customer declared in the deal registration], you will receive a code for every €1,000 MSRP of qualifying units sold, to check via the website: racetosuccesproducts

3.4 Winners have fourteen (14) days to reply to claim the prize. If a winner does not reply within 14 days, the winner’s prize will be forfeited and may be awarded to another eligible participant.

3.5 All prizes must be accepted as awarded and may not be transferred, substituted or redeemed for cash or otherwise.

3.6 Prizes are offered “as is” with no written, express, or implied warranty.

DATA PRIVACY

5.1 EPOS will be collecting personal data about participants, in accordance with its privacy notice. The information you provide will only be used for the purpose of the competition unless you also provided consent to receive EPOS marketing communications. Please review EPOS’ privacy notice at https://www.eposaudio.com/legal/privacy-notice. By participating in the competition each participant hereby agrees to EPOS’s collection and usage of his/her personal information for the purpose of the competition as set out herein and acknowledges that he/she has read and accepted EPOS’ privacy notice.

LIMITATION OF LIABILITY

6.1 To the extent permitted by law, EPOS is not responsible for:

Any incorrect or inaccurate information associated with or utilized in the competition;

Technical failures of any kind including, but not limited to malfunctions, interruptions or disconnections in phone-lines or network, hardware, or software;

Unauthorized human intervention in any part of the competition;

Technical or human error which may occur in the administration of the competition; or

Any injury or damage to persons or property which may be caused directly or indirectly, in whole or in part from participants participation in the competition (including the winner’s participation in the event).

6.2 EPOS is responsible for prize availability, but not for prize utility or quality or otherwise.

6.3 Notwithstanding the above, EPOS cannot be held responsible for prize availability if the event is cancelled for reasons outside the reasonable control of EPOS.

6.4 The reporting and payment of any taxes on prizes, if necessary, are the sole responsibility of the winner.

REVOCATION, TERMINATION AND WITHDRAWAL

7.1 Participants may withdraw from the competition at any time. Within reasonable time upon notification, EPOS will delete all data collected from the participant. Participants may declare their withdrawal at any time to EPOS.

7.2 Revocation of the right to use participant’s personal data is possible at any time. However, such revocation will necessarily be followed by the exclusion of the participant from the competition.

7.3 EPOS reserves the right to cancel or end the competition at any time, without notice or reason.

APPLICABLE LAW AND JURISDICTION

8.1 The competition is governed by and construed in accordance with English law, excluding its conflict of law rules. Any disputes arising under the competition will be settled by the English courts.

MISCELLEANOUS

9.1 The invalidity or unenforceability of any provision of these terms and conditions will not affect the validity or enforceability of any other provision. In the event that any provision of the terms and conditions is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

9.2 EPOS’ failure to enforce any term of these terms and conditions will not constitute a waiver of that provision.
